IBAS case

  • Raised a case with IBAS tonight, mostly just to see what their remit is and whether you can pursue free bets not paid due to the bookie saying you’re gubbed without notification.

    Bookie concerned here is sportingbet and I raised it because 1. its £50 in free bets and 2. everything the agent claimed to me on live chat was untrue.

    This was on the money back second offer for Sundays racing, I managed to hit two second places. So I went on live chat because the 48 hour time frame had elapsed for free bets to be credited.

    I was told I was ineligible for the offer because of a decision taken by the marketing team “some time ago”. Furthermore the only promotions I could do were ones that appeared on the page when I logged in. This was ridiculous because they emailed me on Saturday telling me about the offer on Sunday and it appeared in my promotions section too. I argued that there was no way of knowing the three races the offer applied to that day if I hadnt been emailed or seen what the races were in the T&C’s. Furthermore I got no gubbing email.

    Anyway, I’m not holding out, I’ve heard IBAS are like OFGEM and OFWAT etc, i.e they are token organisations set up to make it look like the average customer has someone on their side but ultimately they have no power to do anything.

    Will let you know how I get on as this is effectively a test case.

    Sorry to hear that Chris. I hit 2 on Sunday too, they hadn’t been paid by this evening. Your post reminded me to check and they’ve just been credited.

    Interested to hear how you get on though as it is appalling behaviour to gub without notifying, but continue to directly market the promotions. Furthermore to fob you off with that guff about only being available if you can see it when you log in seems to be a case of live chat making it up as they go.

    Good work Chris – will be very interesting to see your results. However, like you, I imagine they exist simply to give the appearance of regulation, when in fact they have little or no power to act on behalf of customers.

    I imagine the bookies are covered by standard lines in their terms such as “we reserve the right to remove this promotion at any time” etc

    I’d be more interested to see the result of those who were screwed by Scumbets on the Liverpool game the other day; clear case of unfairness. The very least that should have happened there was that the odds were reduced to what they claimed they should have been and paid out at that price.

    As you say, these organisations really are ‘toothless tigers’ and I can’t see how you will get anywhere on this one given the bookie reserving the right to pull offers whenever suits.

    These bookies are all bloody farcical. I went on Mr Green earlier as i had some free spins. Got through them and won a few quid. Did the usual x35 wagering and was left with about £8. Thought id just bung it on the next fav at Chelmsford. Imagine my surprise when i could only get £5 on a 5/2 shot. I take it im gubbed as its same platform as 888 and unibet. Ballbags havent mailed me to let me know though.

    So just to provide an “update”.

    Not heard a thing. Raised the case in January, got an email 2nd February saying it would be resolved in 10-14 weeks.

    Unfit for purpose and completely pointless. A quango to make it look like the industry is regulated.

    Chris, i don’t know whether its worth reporting them to CMA? Or possibly even reporting IBAS to CMA seeing as they seem incapable of doing what they are supposed to …

    Chris a mate of mine is in a dispute with willhill from a football acca dating back to 2nd August last year. He sent the case to IBAS within 2 weeks of this date and heard earlier this week the outcome which basically offered him 10% of the amount is he entitled to. Anyway, you then have 40 days to challenge the evidence if you feel the outcome is wrong and they will have another look. In this case Willhill have supplied IBAS with incorrect information to try and cover themselves.

    Even if IBAS do not rule in his favour he is not ruling out court action. He also had to email IBAS 2-3 times politely asking them if there was an update or an idea of when a ruling would be made.

    Good luck Chris and I hope you hear soon but if its similar to what happened to my mate in timescale then you could be looking at around October before hearing a response which in my opinion is pretty shambolic.

    Chris, You would be better going to ASA (Advertising Standards Aithority)

    The bookie e mailed you directly about the offer, therefore it is reasonable of you to expect that you would qualify for the promotion. ASA aim to resolve cases in 10 days. I’m sure you would win your case.

    Theiir are plenty of examples of people being successfull in exactly this type of case. It tends to be when a bookie gubs you but then e mail you a promotional offer because the system has not yet removed your address. The bookies defence to ASA tends to be “it can take 24-48hrs for a persons e mail address to be removed from our promotional address book” ASA response “update your systems, in the meantime credit this customer with what they have every right to believe they were entitled to”.
