Bookies and Unfair Contract Terms legislation

  • Just curious – has the Bookie industry ever had their T&Cs tested under the Unfair Terms in Consumer Contracts Regulations 1999? The blanket “we can do what we want whenever we want, without having to tell you, and you can’t do anything about it” term in bookies T&Cs seems to fit the unfair tag exactly.

I’ve also read a couple of blog posts indicating that that bookies have, in the past, paid out disputed unpaid winnings immediately whenever challenged in the Small Claims Court, presumably so as not to have their T&Cs examined in open court.

    Anyone with insider knowledge?

the UK parliament is looking into all aspect of the gambling industry at the moment although its more focussed on FOBTs I have heard a couple of MPs talk about unfair bonus terms (especially for casino offers where its 50x deposit etc)

Of course, if you want your account ungubbed, you could always become an MP and start making gushing speeches about Ladbrokes in the house of commons. Worked for this guy

Interesting post. Like all contracts, terms have to be lawful to be enforceable. I would say in most cases whats stated in bookie T&C’S isn’t enforceable and I too often have wondered how they get away with this, not to menton breach of advertisement regulations.

e.g enticing punters to part with their own funds in order to receive a freebet/bonus to have your stakes restricted so one cannot avail the bonus. A blatent con that seems to be rife with bookies these days.

Gambling commisions wont deal directly with these issues and IBAS will deal with them but who’s going to go through all that for a 20/50fb or whatever. it’s not viable to pursue. Funny because you dont very often hear of compensation in these IBAS cases do you. Wonder why…

On the whole i believe these things go ignored time and time again with the same culprits. So you have to ask yourself, where’s the real deterrent for the bookies not pull these stunts on their T&C’s? Only reason the main bookies don’t pull it so much is because they have a brand to protect.

And why should a punter have to spell out the stunts these bookies pull when they are clear as day?

Regulation is the problem here, they turn a blind eye to it. And it doesnt take a genius to work out why that is….£££££ Just mt opinion on it.
